ROAD ACCIDENT FUND:
If you were involved in a motor vehicle accident within the past two years where the identity of the other party is unknown or within the last three years where the identity of the other party is known it is possible to institute action against the Road Accident Fund for medical expenses, loss of amenities of life, funeral expenses etc.
A claim against the Road Accident fund doesn’t include damages to your vehicle but rather personal injuries or death.
A claim for funeral expenses can also be instituted but is limited to the actual necessary expenses.
It is important to appoint an attorney as soon as possible after the accident to avoid prescription of the claim. It is also possible to institute a claim against the Road Accident Fund in person but it is not recommended. There are technical statutory requirements to adhere to failure of which can hinder further legal action should the claim be rejected.
